This bill establishes new regulations for the use of artificial intelligence (AI) in mental health services within Missouri. It defines AI broadly as any artificial system capable of performing tasks without significant human oversight, learning from experience, or mimicking human cognitive abilities. The bill also clarifies that a "mental health professional" includes those licensed under existing Missouri laws for mental health professions. Crucially, the bill prohibits any person or entity from advertising or claiming that their AI can act as a mental health professional or provide therapy, psychotherapy, or mental health diagnoses. Violations of these provisions are considered unlawful practices under Missouri's merchandising practices act, and the Attorney General is empowered to enforce them through civil actions, with penalties of $10,000 for a first offense and $20,000 for subsequent offenses, in addition to other potential remedies like damages and injunctions.
