This bill establishes comprehensive regulations for addressing bed bug (Cimex lectularius) infestations in residential properties, placing specific responsibilities on both tenants and landlords. Tenants must immediately notify landlords in writing upon discovering bed bugs, allow property owners and pest control professionals to enter the unit with 24-hour notice, comply with all extermination protocols like bagging personal property and removing potentially infested items, and grant access for inspections and treatments. Landlords must commence extermination within 5 business days of notification, notify surrounding units, and continue treatments until the infestation is resolved, which is defined as no bed bug activity for 30 consecutive days. The bill also requires the Department of Public Health to create informational materials explaining bed bugs, prevention strategies, and the legal obligations of tenants and landlords. If a landlord fails to address a known bed bug infestation before leasing a unit, the lease can be voided. Tenants who obstruct or fail to cooperate with extermination efforts can be held financially responsible for any resulting damages. The executive office of housing is authorized to develop additional regulations to implement these provisions.
