This bill modifies existing laws regarding toxicology testing in Washington State, specifically concerning driving under the influence (DUI) cases. It allows for blood or breath analysis to be considered valid if performed either by an individual with a permit from the state toxicologist or by a laboratory that is certified or accredited according to the ISO/IEC 17025 standard for forensic toxicology testing. This ISO/IEC 17025 standard is an internationally recognized benchmark for the competence of testing and calibration laboratories. The bill also outlines procedures for local governments to obtain previously submitted evidence from the state toxicological laboratory for testing by such accredited laboratories, requiring contracts with the Washington State Patrol for reimbursement of costs related to packaging, handling, and transporting the evidence. Additionally, it clarifies the conditions under which breath tests are admissible in court, including specific requirements for the testing instrument and the observation period before the test, and it updates the list of qualified healthcare professionals who can withdraw blood for testing. Importantly, the changes made by Section 1 of this act are set to expire on June 30, 2027, with the changes in Section 2 taking effect on June 30, 2027, indicating a phased implementation of these new toxicology testing provisions.
