This bill, titled the "Ensuring Transparency, Honesty, and Integrity for Contracting, Acquisition, and Lifecycle Procurement Act" or the "ETHICAL Procurement Act," prohibits the Secretary of Defense from awarding contracts to companies where certain government employees or their immediate family members hold significant positions or ownership stakes. Specifically, it prevents contracts with entities if an officer, director, partner, or majority owner is a presidential appointee confirmed by the Senate, holds a confidential or policy-determining role in the executive branch (Schedule C), is a special government employee (someone employed part-time or intermittently for government), or is in the Senior Executive Service. Additionally, it prohibits contracts if an immediate family member (parent, child, sibling, spouse, or domestic partner) of the President, or of someone in the aforementioned government positions, is an officer, director, or partner of the company, or holds a significant ownership interest or would substantially benefit financially from the contract. The Secretary of Defense is required to issue regulations within 30 days to define terms and establish procedures for implementing this prohibition.
