This bill prohibits political subdivisions, which include municipalities, counties, and school districts, from enacting or enforcing any policies, ordinances, or deed restrictions that prevent property they sell, lease, or transfer from being used by a charter public school for lawful educational purposes. It also establishes a right of first refusal for public entities, including the state and its political subdivisions, to purchase or lease unused school facilities that a school district has no immediate plan to use for academic, extracurricular, administrative, or sports purposes within two years. If a school district offers such a facility to another party, it must first notify potential public entity buyers or lessees, giving them sixty days to express interest, and if multiple public entities are interested, the school district will make the final selection, with negotiations for sale or lease at fair market value or less.
