This bill requires employers to provide written notice to employees at least 30 days before using "electronic monitoring" – which means collecting information about an employee's activities or communications through any means other than direct, in-person observation, including technologies like artificial intelligence, cameras, or recording devices – to assist in performance evaluations. If an employer is already using such monitoring when the law takes effect, they must provide notice within 30 days. For new hires, this notice must be given at the time of the job offer. The notice must state that electronic monitoring is used and whether a "meaningful human review" process is in place to verify the data collected. Exceptions exist for emergencies where immediate monitoring is necessary, provided the employee is notified as soon as practicable and followed up with written notice. The bill also establishes penalties for violations, allows for investigations by the department of labor and industries, and permits employees to bring civil actions for damages. Employers are required to keep records of these notices for at least three years.
