This bill expands the definition of personality rights to include "forged digital likeness," which refers to digitally created or altered visual or audio representations of an individual that are indistinguishable from genuine recordings and are likely to deceive a reasonable person. The bill amends existing laws to incorporate this new category into the protections afforded to individuals and personalities, both living and deceased, regarding the unauthorized use of their name, voice, signature, photograph, or likeness. It clarifies that these rights are transferable and do not expire upon death. Furthermore, the bill increases the civil penalty for infringing these rights to $3,000 and allows for recovery of actual damages, profits attributable to the infringement, and, specifically for forged digital likenesses, noneconomic damages even if no profit was made. It also provides for injunctive relief, impounding of infringing materials, destruction of infringing items, and recovery of attorney's fees for the prevailing party.
