This bill creates a temporary exemption from licensing requirements for certain tobacco and nicotine product retailers. Specifically, a person who was already selling these products before the law's effective date can be exempt from licensing provisions if they have submitted a license application to the department and are waiting for approval. To qualify, the retailer must file an affidavit confirming they previously sold tobacco/nicotine products legally, have submitted a pending application, and have not yet been granted a license. The exemption automatically expires once the department completes its review of the license application. This bill is part of a package of related legislation and will only take effect if four companion bills (House Bills 5370, 5372, 5371, and 5368) are also enacted into law. The bill amends the existing Youth Tobacco Act and appears designed to provide a transitional period for existing retailers to obtain the newly required licenses without interrupting their business operations.
