This bill, titled the "Auto Data Privacy and Autonomy Act," aims to give owners of "covered vehicles" (which include motor vehicles and vehicles primarily used for farming or construction) more control over their data. It prohibits manufacturers from accessing, selling, or sharing "covered data" – which encompasses both user data (data transferred to the vehicle by the owner) and vehicle-generated data (all electronic data created by the vehicle, including its location) – without the owner's explicit, written, and easily withdrawable consent, unless it's to improve vehicle performance or safety, or if legally required by a warrant or court order, or to facilitate an emergency response. The bill also restricts manufacturers from selling or sharing personally identifiable information with specific foreign governments: North Korea, China, Russia, Iran, and Venezuela. Furthermore, manufacturers must provide vehicle owners with free, real-time access to and control over all their vehicle's data through the vehicle's interface and wireless transmission, allowing for data deletion and setting user preferences without requiring additional fees or proprietary technology. The Federal Trade Commission (FTC) will enforce this act, treating violations as unfair or deceptive practices, and is required to report to Congress on various aspects of vehicle data access and security.
