AI Summary
This bill aims to streamline and modernize building permit and inspection processes across Florida by introducing several key changes. It establishes clearer expiration timelines for building permits issued by counties and local governments, generally setting them at one year or the effective date of the next building code edition, whichever is later, while allowing for extensions. The bill mandates the Department of Management Services to establish state term contracts for building code inspection services and allows individuals qualified in other states or with extensive experience to perform inspections and plan reviews during declared states of emergency. It also clarifies that contractors are not subject to discipline for performing work without permits if otherwise authorized by law, and prohibits the Department of Business and Professional Regulation from denying permits for certain residential manufactured buildings. A significant provision defines "offsite-constructed residential dwelling" and requires these homes to be permitted "as of right" in any zoning district allowing single-family homes, prohibiting local governments from treating them differently or more restrictively than site-built homes, while still allowing for reasonable, uniformly applied compatibility standards. The bill mandates the Florida Building Commission to develop uniform commercial and residential building permit applications by July 1, 2027, and revises permit expiration rules for local governments, introduces exemptions for work valued below $7,500 and for temporary hurricane/flood protection barriers, and prohibits dividing projects to evade permit requirements. It also addresses inspection fees, prohibiting punitive administrative fees and requiring fees to be based on actual inspection costs, and introduces provisions for reduced permit fees when private providers are used for inspections. Furthermore, the bill streamlines the use of private providers for building code inspection services by requiring electronic registration systems, prohibiting additional forms beyond registration, and clarifying that local enforcement agencies are not responsible for supervising private provider services. It also sets specific timeframes for local governments to make decisions on building permit applications and prohibits homeowner associations from requiring a government-issued building permit as a prerequisite for their own review of improvements.
