This bill establishes a process for recalling elected municipal officers in Wyoming, allowing qualified voters to remove an officer through a petition and subsequent election. To initiate a recall, a petition must be signed by at least 40% of the registered electors who voted for the officer in their last election, and it must state the general grounds for removal. Signatures must include the signer's address, and one signatory must attest to the petition's authenticity. Collecting signatures for payment is prohibited. The city clerk has ten days to verify the petition's sufficiency, with potential assistance from the governing body and county clerk for signature verification, with costs reimbursed to the county. If sufficient, the clerk certifies the petition, and the governing body schedules a recall election between 30 and 40 days later, where voters decide whether to remove the officer. A recall petition cannot be filed until an officer has served at least nine months and no less than six months before the next regular election, and only one recall election can be held per officer per term. If a majority votes for removal, the officer is removed, creating a vacancy to be filled according to existing laws. This new recall procedure is in addition to any other legal methods for removing officers and repeals a duplicative existing provision, becoming effective on July 1, 2026.
