This bill amends Delaware law concerning controlled substances by changing how public consumption is penalized. Previously, consuming controlled substances in public areas or moving vehicles was an unclassified misdemeanor. Now, the bill distinguishes penalties based on the location and role of the individual: using a personal use quantity of a controlled substance or counterfeit controlled substance while operating a moving vehicle is an unclassified misdemeanor with a potential fine of up to $200 and/or 5 days imprisonment; being a passenger in a moving vehicle while consuming such substances is an unclassified misdemeanor with a fine of up to $100; and consuming these substances in an area accessible to the public, such as sidewalks, streets, parks, or within a certain distance of public areas or buildings, is a civil violation with fines of up to $50 for a first offense and $100 for subsequent offenses. The bill also clarifies what constitutes an "area accessible to the public" by listing specific locations and defining proximity to them.
