This bill establishes new requirements for multifamily residential developments in the Prescott Active Management Area (AMA) regarding water supply. Specifically, municipalities and counties cannot approve building permits for multifamily properties in this area unless the applicant provides either a written commitment of water service from a designated water provider with an assured water supply or obtains a certificate of assured water supply from the state Department of Water Resources. The bill defines a "multifamily residential property" and "residential lease community" as six or more detached residential dwelling units intended for lease, with some exceptions for agricultural worker housing. Existing zoning entitlements obtained before the bill's effective date are exempted from these requirements. The bill also amends existing water supply statutes to clarify that for multifamily properties in the Prescott AMA, "sufficient groundwater" means proposed groundwater withdrawals over 100 years will not exceed a specified depth and will be consistent with the area's water management goals. Additionally, the bill requires the director of the Department of Water Resources to study and report on building permit requirements for six or more residences within active management areas by December 31, 2023.
