This bill requires a retail establishment to refund a consumer for merchandise purchased at a self-service or automated retail kiosk operating within, but not operated by, the retail establishment. Under the bill, a consumer would be required to provide the retail establishment with a receipt or other proof of purchase to receive a refund. The bill also requires the operator of a self-service or automated kiosk to reimburse a retail establishment for the cost of a refund provided to a consumer under the provisions of the bill. A retail establishment or operator of a self-service or automated kiosk that violates the provisions of the bill is subject to a civil penalty of up to $2,500 for a first offense and up to $5,000 for a second offense, to be collected in a civil action by a summary proceeding under the "Penalty Enforcement Law of 1999," P.L.1999, c.274 (C.2A:58-10 et seq.).
