AI Summary

This bill, known as the "Florida Age Gate Act," aims to regulate the sale and marketing of nicotine products, particularly focusing on devices that have not received FDA marketing authorization. The legislation requires the Division of Alcoholic Beverages and Tobacco to conduct regular inspections of retail nicotine product dealers, especially those selling unauthorized nicotine dispensing devices. Dealers who accept a retail nicotine products permit agree to inspections by both the division and the Department of Law Enforcement. The bill establishes a graduated penalty system for violations, with fines ranging from $500 to $5,000 and potential permit suspensions or revocations for repeated infractions. Retailers are prohibited from advertising, promoting, or displaying nicotine dispensing devices that lack FDA marketing granted orders, particularly in areas visible to individuals under 21 years old. Exceptions are made for establishments that completely prohibit individuals under 21 from entering and for devices that have received FDA marketing authorization. The bill also requires the division to include the number of violations related to unauthorized nicotine device marketing in their annual report to the Legislature, with the new regulations set to take effect on July 1, 2026.
