This bill amends existing South Dakota law regarding criminal background investigations for school employees. It clarifies that instructors employed by technical colleges must undergo these investigations at the time of initial employment, and that the investigations for student teachers, conducted by accredited schools, can be shared with other schools where the student teacher engages in practice. The bill also specifies that if an accredited school employee works for multiple schools, they only need one background check if it was completed within the last five years and the results are transferred with proper authorization. Furthermore, it reiterates that schools can refuse to hire individuals convicted of certain crimes, including those involving moral turpitude, crimes of violence, sex offenses, or trafficking in narcotics, and can consider any criminal conviction in hiring decisions. Finally, it maintains an exemption for individuals continuously employed by the same accredited school since July 1, 2000, from needing to resubmit to background checks.
