This bill modifies Missouri's law on unlawful possession of a firearm by expanding the categories of people prohibited from possessing firearms. Specifically, the bill adds a new provision targeting certain non-citizens, making it illegal for an alien who is either in the United States illegally or has been admitted under a nonimmigrant visa to possess a firearm, unless they qualify for a specific federal exception. The existing law already prohibited firearm possession for people with felony convictions, fugitives from justice, individuals habitually intoxicated or drugged, and those adjudged mentally incompetent. The bill maintains the existing penalty structure, which classifies unlawful firearm possession as a class C felony, but escalates it to a class B felony if the person has a prior conviction for unlawful firearm possession or has been convicted of a dangerous felony. The law continues to include an exception for antique firearms. This change appears intended to further restrict firearm access for non-citizens who do not have permanent legal status in the United States.
