This bill removes the authority of the Virginia Military Institute (VMI) to require cadets who report sexual violence and admit to their own drug or alcohol use to attend counseling, even if that use is deemed a threat. Previously, VMI could include a provision in its policies allowing its superintendent to mandate such counseling for cadets who disclosed their personal consumption of drugs or alcohol in conjunction with a good faith report of sexual violence, provided that consumption posed a threat to the cadet or others. This bill eliminates that specific discretionary power for VMI, ensuring that all public institutions of higher education, including VMI, must grant immunity from disciplinary action for personal drug or alcohol use when disclosed as part of a good faith report of sexual violence, without the exception for mandatory counseling.
