This bill allows the Arizona Department of Water Resources to review applications for a certificate of assured water supply, which confirms that a sufficient water supply is available for a specific area, for land in the Phoenix active management area that was applied for between January 26, 2021, and August 31, 2023, and for which a certificate has not yet been issued. If the municipal provider for the land agrees to annually assign long-term storage credits to the Central Arizona Groundwater Replenishment District (CAGRD), a district responsible for replenishing groundwater, equal to twenty-five percent of any excess groundwater delivered in the previous year, and the CAGRD can purchase these credits, then the Department will issue a new determination. This process aims to ensure groundwater availability and manage replenishment obligations, with a provision that if specific groundwater models were used to support the application, the physical availability requirement will be met. The bill also mandates notification to eligible applicants and clarifies that certificates issued under this provision will be considered as if issued in 2023 for certain designation purposes, and this section of the law will be repealed on December 31, 2028.
