This bill modifies existing laws regarding school impact fees, which are charges imposed on new development to help fund public facilities needed to serve that development. Specifically, it allows school districts that are under certain financial distress, such as being in "binding conditions" or "enhanced financial oversight" (meaning they are facing financial difficulties and are subject to special supervision), to use up to 25% of their collected school impact fees for their general operations and maintenance, but only for as long as they remain under that financial oversight. If a school district is under enhanced financial oversight, the use of these funds for operations and maintenance must be approved by a special administrator appointed to oversee the district's finances. The bill also permits impact fees to be used for modernizing school facilities if the existing funds are nearing their expiration date for use (within four years) and the modernization is necessary for student safety, campus security, emergency response, or energy efficiency. Finally, this bill repeals a previous law related to extending the use of school impact fees and includes an expiration date of January 1, 2036, for the changes made in Section 1.
