This bill modifies the Climate Commitment Act (CCA) to ensure that all fuel supplied or sold in Washington is subject to compliance obligations, aiming to create a more equitable marketplace for fuel suppliers. It lowers the threshold for certain fuel suppliers, like those selling gasoline, diesel, biodiesel, or propane, to be considered "covered entities" under the CCA. Previously, smaller suppliers were exempt if they supplied less than 25,000 metric tons of associated carbon dioxide equivalent annually, but this bill introduces lower thresholds for new market entrants and those who began operations after January 1, 2023, requiring them to comply if their emissions reach 500 metric tons or more. Additionally, beginning January 1, 2027, fuel sellers will only be eligible for state contracts if they are registered with the Department of Ecology as a covered or opt-in entity under the CCA, or if they can prove their fuel was purchased from such a registered entity. The bill also mandates that the Department of Ecology's roster of covered entities will specify the provision of law under which each entity is covered and identify fuel sellers subject to these new regulations.
