This bill, known as the Kansas Motorsports Venue Protection Act, shields motorsports venues, defined as designated areas for competitive vehicle and motorsport races including tracks, spectator areas, and associated grounds, from civil lawsuits based on nuisance, taking, or similar legal claims, provided the venue was established in Kansas before a surrounding property owner acquired their land or built on it. A surrounding property owner is defined as anyone owning property within a five-mile radius of a racing facility or racetrack. This protection does not apply if the venue materially violates state or local laws or permit conditions, or if the venue has not held a competitive race in the four years prior to the surrounding property owner's acquisition of their property. The act also clarifies that it does not affect other types of civil actions or the enforcement authority of government bodies for unrelated violations, and its provisions are severable.
