This bill, known as the Kansas Motorsports Venue Protection Act, aims to shield motorsports venues, defined as designated areas or facilities for competitive vehicle and motorsport races including associated grounds and buildings, from civil lawsuits based on claims of nuisance, taking, or similar legal theories. Specifically, a racing facility or racetrack will be granted immunity if it was established in Kansas before a surrounding property owner, defined as someone owning property within a five-mile radius of the venue, purchased their land or constructed improvements on it. However, this protection does not apply if the lawsuit alleges a significant violation of state or local laws or a condition expressly forbidden by a valid permit for the venue, nor does it apply to lawsuits brought by owners whose property is within a five-mile radius if the venue has not held a competitive race in the four years prior to their property acquisition. The act also clarifies that it does not affect other types of civil actions or the enforcement authority of the state or local governments for violations unrelated to nuisance or taking claims, and its provisions are severable.
