This bill modifies the procedure for filling vacancies in the Missouri General Assembly by updating the language in Section 21.110 of the state's Revised Statutes. Currently, when a vacancy occurs in either legislative house, the governor must issue a writ of election to fill the position. The proposed changes include adding gender-neutral language by replacing "he" with "he or she" and changing the requirement from being "satisfied" to being "notified" of a vacancy. The bill also introduces a new provision that exempts the governor from calling a special election if the vacancy occurs within 40 weeks (specifically, after the fortieth Tuesday) before the end of the member's term. Additionally, the bill requires the governor to issue the election writ within seven days of receiving a resignation, notice of vacancy, or being notified of a member's death, removing the previous language of "without delay" and eliminating the specification of the vacancy occurring during a legislative recess.
