This bill amends existing South Dakota law to expand the types of vehicles that can be included in the process of obtaining a title for a vehicle left with a repair shop due to an unpaid repair bill. Specifically, it clarifies that this process applies to motor vehicles, boats, mopeds, motorcycles, off-road vehicles, snowmobiles, and trailers. The bill outlines that a repair facility possessing such a vehicle due to an unpaid bill can request the last known contact information for the vehicle's owner and any lienholders from the state's department of motor vehicles. If the owner fails to pay the repair bill, the repair facility can then apply for a new title after providing written notice to the owner and any lienholders, and allowing a 30-day period for them to reclaim the vehicle by paying the repair costs. If the vehicle is not reclaimed within this period, the repair facility can obtain title and sell the vehicle at public auction, with any proceeds exceeding the repair bill being returned to the original owner or lienholder, or sent to the state treasurer if they are unidentifiable or cannot be contacted.
