This bill amends the definition of "cohabitant" in Utah law, primarily to expand its scope in two key areas: first, to include individuals who are minors when a parent or stepparent commits a crime against them, or when a minor commits a crime against their parent or stepparent, thereby broadening the application of battered person mitigation in criminal cases; and second, to clarify and slightly modify the existing definition of cohabitant in the context of protective orders, including relationships by consanguinity or affinity to the second degree and explicitly excluding certain parent-child and sibling relationships when the other party is a child. The bill also defines "parent" and "minor" for clarity and sets an effective date of May 6, 2026.
