This bill temporarily amends the Clemency Board Establishment Act of 2018 to allow the Clemency Board to grant waivers for the 5-year waiting period required for pardon applications. Specifically, the Board can waive this waiting period if the applicant has received a waiver from the Office of the Pardon Attorney or the President of the United States, as outlined in the Department of Justice Manual. However, the Clemency Board retains the discretion to deny a waiver even if federal approval is granted, and waivers will not be issued to individuals currently on probation, parole, or supervised release. The Board may also request additional information from applicants, including a meeting, and must provide written notification of its decision, with the application being deferred until a waiver determination is made. This temporary measure will expire after 225 days.
