This bill, effective July 1, 2026, creates a new chapter in Indiana law concerning single-sex public restroom trespass, making it a Class B misdemeanor for a male to knowingly or intentionally enter a restroom designated for females, or for a female to knowingly or intentionally enter a restroom designated for males. The bill defines "female" as an individual born female or having at least one X chromosome and no Y chromosome, and "male" as an individual born male or having at least one X and at least one Y chromosome. Certain defenses are provided, including entering a restroom for custodial purposes, to render assistance, or if a person under twelve years old accompanies a parent, guardian, custodian, teacher, or babysitter into a restroom designated for that accompanying adult's gender.
