Licensed professionals can use AI for administrative support, such as scheduling and billing, and for supplementary support, like preparing client records or analyzing anonymized data, but only if they maintain full responsibility and, for supplementary support, obtain explicit, informed, and revocable written consent from the client after informing them about the AI's use, purpose, and data handling, with the caveat that AI cannot make independent therapeutic decisions or directly interact with clients in a therapeutic capacity. The bill also clarifies that clients cannot be denied services for not consenting to AI use for supplementary support, ensures AI use complies with confidentiality laws, holds licensees responsible for AI actions, and allows clients to pursue legal action for harm caused by AI in therapy, with exceptions for AI used in approved research projects.
