Bill Summary

Health Care Learning Lab and Regulatory Improvement Program established. Requires the Department of Health (the Department) to establish the Health Care Learning Lab and Regulatory Improvement Program (the Program) to enable a person to obtain limited access to the market in the Commonwealth to temporarily test an innovative health care product or service on a limited basis without otherwise being licensed or authorized to act under the laws of the Commonwealth. Under the Program, an applicant requests the waiver of certain laws, regulations, or other requirements for a 24-month testing period, with an option to request an additional six-month testing period. The bill provides application requirements, consumer protections, procedures for exiting the Program or requesting an extension, and recordkeeping and reporting requirements. The bill requires the Department to provide an annual report to the Chairs of the House Committee on Health and Human Services and the Senate Committee on Education and Health that provides information regarding each Program participant and recommendations regarding the effectiveness of the Program. The bill directs the Board of Health to adopt emergency regulations to implement the provisions of the bill and has an expiration date of July 1, 2030.

AI Summary

This bill establishes the Health Care Learning Lab and Regulatory Improvement Program, managed by the Department of Health, to allow individuals or companies to test innovative health care products or services in the Commonwealth for a limited time without needing full state licensure or authorization. Applicants must meet specific criteria, including demonstrating jurisdiction, having accessible testing locations, providing personal and contact information, disclosing criminal convictions, showing they have the resources to test and monitor their innovation, and detailing how their product or service differs from existing ones, benefits consumers, and any associated risks. The program allows for an initial 24-month testing period, with a possible six-month extension, and requires participants to provide clear disclosures to consumers about the testing nature of the product or service and potential risks. The bill also outlines procedures for exiting the program, including notifying the Department of Health, and grants the Commissioner the authority to suspend or revoke participation if public health or safety is jeopardized or if the participant is not acting in good faith. The Department of Health is required to submit an annual report to legislative committees on program participants and its effectiveness, and the program is set to expire on July 1, 2030, with the Board of Health directed to adopt emergency regulations to implement its provisions.
