Specifically, it mandates that these services must obtain explicit consent from users before sharing, selling, or using any "reproductive or sexual health application information," which includes details about a person's menstrual cycle, fertility, pregnancy status, plans to conceive, or sexual activity. Furthermore, government entities, including state agencies and law enforcement, are generally prohibited from demanding this information from health digital services, except in limited circumstances for criminal investigations unrelated to abortion laws or determining pregnancy outcomes or gender transition care received in other states.
