This bill, effective January 1, 2027, requires health carriers and health benefit plans in Missouri to cover prescription drugs as prescribed by a patient's healthcare provider, preventing them from forcing patients to switch to a different drug they deem more appropriate unless the patient's healthcare provider provides written approval that the switch is in the patient's best health interest. This provision applies to health benefit plans delivered, issued, continued, or renewed in the state, and it defines "enrollee," "health care provider," "health carrier," and "health benefit plan" as they are defined in existing law (section 376.1350). However, this bill does not prevent the substitution of interchangeable biological products, as outlined in section 338.085, nor does it apply to prescription drug coverage managed through a "step therapy protocol," which is a process where patients must try certain medications before a health plan will cover a more expensive one, as described in section 376.2034.
