This bill, effective July 1, 2026, prohibits local governments from issuing construction permits for new solid waste disposal facilities that use incinerators producing ash or for waste-to-energy facilities if they are located within a 2-mile radius of certain large water impoundment areas, which are important for water management and protecting endangered species. Similarly, the Department of Environmental Protection (DEP) is also prohibited from issuing such permits under the same conditions. These restrictions do not apply to canals, existing facilities or operations as of July 1, 2026, or to parcels in counties with a population under 1.7 million. The bill also makes conforming changes to cross-references within Florida Statutes related to waste management definitions and goals, ensuring that references to recycling goals and permit requirements are updated to reflect the new provisions.
