This bill modifies the offense of possessing unlawful items in a prison or jail by adding unauthorized portable electronic communication devices, such as cell phones and pagers, to the list of prohibited items. These devices are defined as any substantially similar item used to initiate or receive communication or store and review information, videos, images, or data. The bill also clarifies the penalties for various violations, making the possession of these unauthorized electronic devices a class D felony, similar to possessing controlled substances. The existing law already prohibits controlled substances, intoxicating liquors, and items prisoners are forbidden from possessing, as well as weapons that could endanger safety.
