This bill revises Florida law regarding medical debt by redefining "extraordinary collection action" to include selling debt only under strict conditions, such as prohibiting excessive interest and ensuring debtors eligible for financial assistance are not overcharged. It also defines "medical debt collector" as a third party collecting unpaid medical bills and "medical debt creditor" as the entity owed money for medical services. Crucially, the bill prohibits medical debt creditors and collectors from engaging in aggressive tactics like threatening arrest, filing lawsuits, placing liens, foreclosing on property, garnishing wages, seizing bank accounts, or reporting negative information to credit agencies. Furthermore, it limits the interest charged on medical debt to 2% per annum unless the debtor is eligible for financial assistance, in which case no interest or late fees can be charged, and these interest rate limitations will also apply to any judgments on medical debt.
