"Surveillance footage" refers to video recordings from security cameras that could aid investigations. A "New York state law enforcement agency" is defined by existing criminal procedure law. Businesses are required to take reasonable steps to prevent the destruction of such footage once aware of a potential felony or a request. Furthermore, businesses cannot retaliate against employees who comply with these requests, even if it contradicts company policy. Exceptions to immediate release include a 24-hour period for legal review by the business's counsel and the ability to seek a court order to delay release if it could incriminate the business or violate privacy. Failure to comply can result in penalties, including fines up to $100,000 per incident and civil liability for damages. The Secretary of State will report annually on compliance and challenges.
