This bill, known as the Phone-Down Kentucky Act, prohibits the use of a "mobile electronic device" – defined as a cellular telephone, portable computer, GPS receiver, or similar device used to communicate or display digital content, excluding certain radios and emergency devices – while operating a motor vehicle in Kentucky, with specific exceptions for parked vehicles, reporting emergencies, occupational duties involving data dispatch, first responders, navigation or initiating calls without typing (if not held), and manufacturer-installed vehicle systems. It also clarifies that individuals under 18 with a learner's permit or intermediate license cannot use these devices while driving, except to call for emergency help. Violations will result in a $100 fine, with no points assessed against the driver's record, and the collected fines will be distributed to the traumatic brain injury trust fund, the Kentucky trauma care system fund, and the veterans' program trust fund. For a period between the bill's effective date and October 31, 2026, law enforcement officers will issue courtesy warnings instead of citations for violations.
