Bill Summary
AN ACT to amend the labor law, in relation to employee access to lactation rooms in the workplace
AI Summary
This bill amends existing labor law to strengthen protections for nursing employees in the workplace. It requires employers to designate a hygienic, private, and well-lit space for employees to express breast milk, which must be close to the work area, shielded from view, and free from intrusion. This designated space must include a chair, a working surface, a refrigerator solely for lactation-related purposes, nearby access to clean running water, and an electrical outlet if electricity is available in the workplace. Crucially, this space cannot be a restroom or toilet stall and must be located outside of public restrooms. The bill also mandates that employers develop and distribute a written policy outlining nursing employees' rights, the process for requesting a lactation space, and the employer's response timeframe, which cannot exceed five business days. Furthermore, employers must now publicly post this policy in a clear and conspicuous location in common or break areas, include it in employee handbooks if provided, and make it accessible on the employer's website or the internet.
