This bill, effective July 1, 2026, amends Indiana Code by adding a new section that requires local zoning ordinances to permit residential housing developed by a "religious developer" as a standard use in all residential or commercial zones, provided certain conditions are met. A "religious developer" is defined as a religious institution or a property developer acting on its behalf, where a "religious institution" includes tax-exempt churches, denominations, or organizations recognized by the IRS under section 501(c)(3) of the Internal Revenue Code. "Affordable housing" is defined as residential units for households earning no more than 80% of the area's median income, as determined by the U.S. Department of Housing and Urban Development. The conditions for this permitted use include the development being on property owned by the religious institution, approval by the local legislative body, exclusive use for affordable housing, and obtaining all other necessary permits. Any zoning ordinance in conflict with this new section adopted before July 1, 2026, will be void, though it does not affect permit applications submitted or approved before that date.
