This bill authorizes the Office of Renewable Energy Siting (ORES) to issue permits for battery energy storage systems specifically for data centers, which are defined as facilities primarily used for storing, processing, or transmitting digital information with a significant electrical load of at least one megawatt. This authorization applies regardless of the battery system's storage or transmission capacity, or whether it's located alongside renewable energy systems. However, ORES will not approve permits for battery systems in data centers that do not include renewable energy systems or other approved zero-carbon emission energy sources in their carbon reduction plans. The bill also mandates that all data centers, both existing and new, must develop and submit carbon reduction plans that align with state climate targets, with specific deadlines for submission based on their operational status. The Public Service Law is amended to include these provisions, and the Department is empowered to create necessary rules and regulations.
