This bill, by adding a new section to Chapter 590 of the Missouri Revised Statutes (RSMo), establishes that any statement made by an individual under arrest during a custodial interrogation (meaning questioning by law enforcement while in custody) is presumed to be involuntary if a judge finds that the interviewing peace officer intentionally used information they knew to be false to get the statement. This presumption can be overcome if the state proves with strong evidence that the statement was voluntary and not a result of the false information. Additionally, any peace officer who intentionally uses known false information during a custodial interrogation will face disciplinary action under Chapter 590.
