This bill amends existing law to increase the supply of condominiums by expanding the types of condominium buildings that can be subject to an express warranty of quality and express warranty insurance coverage, which are forms of protection for buyers of new homes. Specifically, it allows developers (referred to as "declarants" or "dealers") to opt out of certain implied warranties of quality, which are standard protections automatically included in home sales, if they provide a specific express written warranty and insurance coverage that meets certain requirements. The bill expands the types of buildings eligible for this alternative warranty to include new or converted buildings with 12 or fewer units and up to four stories, whereas the previous law had stricter limitations on building height and configuration. This express warranty must be acknowledged by the buyer, cover all units and common areas, allow recovery for defects by owners and subsequent purchasers, and include minimum coverage periods for workmanship, systems, and structural defects.
