The core provision grants privilege and confidentiality to communications and records arising from these peer support services, meaning they generally cannot be disclosed, are not considered public records, and are not subject to discovery or admissible in legal proceedings. However, exceptions exist, allowing disclosure with the recipient's consent, or if there's a fear for safety, or in specific legal proceedings where the peer support team member is a defendant. Importantly, these protections do not apply if the communication reveals child abuse, vulnerable adult abuse or exploitation, or if the recipient has committed a criminal act, and peer support team members are protected from liability for making disclosures in certain situations.
