This bill requires residents aged 60 and older in certain long-term care facilities, including nursing facilities, assisted living facilities, personal care homes, and adult foster care homes, to obtain a "preneed contract" within six months of admission. A preneed contract is an agreement for services or merchandise related to a person's final disposition, like funeral arrangements, purchased in advance and governed by specific state laws. If a resident doesn't secure such a contract, the facility must purchase one for them and add the cost to their regular charges. For residents already in these facilities by July 1, 2026, who are 60 or older and lack a preneed contract, they must obtain one by December 31, 2026, or the facility will purchase it. Importantly, facilities are prohibited from refusing admission to individuals or taking negative actions against current residents solely because they do not have a preneed contract, with the State Department of Health responsible for enforcing this provision. This act is set to become effective on July 1, 2026.
