This bill amends Missouri law to add certain psychoactive substances to the list of Schedule I controlled substances, which are defined as having a high potential for abuse and no accepted medical use in the United States. Specifically, it adds 1,4-Butanediol (BDO), Gamma-butyrolactone (GBL), Gamma hydroxybutyrate (GHB), and nitrous oxide to Schedule I. The bill also modifies the offenses of possession and delivery of controlled substances. Possession of a "psychoactive substance" (defined as BDO, GBL, GHB, and nitrous oxide) is now a class A misdemeanor for a first offense, and a class E felony for subsequent offenses, with infractions for those under 18. Delivery of these substances is a class E felony, but a class D felony if delivered to someone under 18. The bill also makes technical changes to how prior convictions are handled and clarifies definitions.
