This bill enhances penalties for certain controlled substance offenses involving fentanyl by adding fentanyl to the list of substances that trigger higher penalty classifications, similar to those for cocaine, heroin, and methamphetamine. Specifically, it introduces new penalties for possessing fentanyl in quantities of at least ten grams, with increased penalties for amounts of twenty-eight grams or more, and the most severe penalties for one hundred forty grams or more, classifying these offenses as Class ID, IC, and IB felonies, respectively. The bill also makes conforming changes to related statutes, including updating references to the new fentanyl penalty provisions within the Public Protection Act (which defines "racketeering activity") and the provisions that offer protections from prosecution for alcohol or drug offenses if a person reports or cooperates in the investigation of a sexual assault. Finally, the bill repeals the original versions of these sections to enact the updated laws.
