This bill, effective July 1, 2026, amends existing Indiana law to increase the minimum distance required between tobacco and vaping businesses and schools. Specifically, it changes the prohibition on operating such businesses from within 1,000 feet of a school building to within 3,520 feet of a public or private elementary or secondary school, measured from the nearest point of the business to the nearest point of a building used for instructional purposes. The bill also makes conforming changes to exceptions for businesses already in operation before certain dates, extending the grandfathering period to July 1, 2026, for businesses that were operating before that date or began operating before July 1, 2026, and were not in violation of the distance requirement at the time they started. Violating this section will be a Class C misdemeanor.
