This bill amends existing law to reclassify assault in the fourth degree as a class C felony when it is sexually motivated and the perpetrator has a history of certain sex offenses or other sexually motivated crimes. Specifically, it adds a new provision that makes assault in the fourth degree a class C felony if it occurs on or after the bill's effective date, is found to be sexually motivated (as defined by RCW 9.94A.835), and the person has two or more prior adult convictions within the last 10 years for specific sex offenses, including assault in the fourth degree with a finding of sexual motivation, or comparable out-of-state offenses. The bill also updates a table that categorizes crimes by seriousness level to include this new classification of assault in the fourth degree.
