This bill, effective July 1, 2026, prohibits the sale, storage, distribution, or use of certain food additives in Indiana, defining these as "prohibited food additives" which include butylated hydroxyanisole (BHA), butylated hydroxytoluene (BHT), Red 40, titanium dioxide, Yellow 5, and Yellow 6. The bill amends existing Indiana Code (IC) to include a new chapter, IC 16-42-5.5, which outlines these restrictions and defines "food" for the purposes of this chapter as articles used for human consumption, including chewing gum and their components. It also establishes that a person who recklessly violates these provisions commits a Class B misdemeanor, and grants the state department the authority to adopt rules for administration and the state health commissioner the responsibility for enforcement.
