Bill Summary

AN ACT to amend the education law, in relation to professional misconduct by physicians, physician's assistants, and specialist's assistants

AI Summary

This bill amends New York's education law to expand the definition of professional misconduct for physicians, physician's assistants, and specialist's assistants by adding several new provisions that address willful misrepresentations made to patients or clients. Specifically, it will be considered professional misconduct to falsely represent unlicensed individuals as licensed, to claim a facility requires private health information that isn't reasonably necessary for the services provided, or to falsely assure patients that their private health information is protected by privacy and security rules, including those under the federal Health Insurance Portability and Accountability Act (HIPAA), when it is not. Additionally, it will be misconduct to misrepresent that an examination or test is for diagnostic or treatment purposes when it is not, or to falsely claim that a facility is licensed by New York State to diagnose, treat, operate, or prescribe for any human condition, or that it adheres to the sanitation or safety standards of a licensed facility when it does not.
