This bill, known as the Certified Help Options in Claims Expertise for Veterans Act, establishes rules for individuals who receive compensation for assisting veterans with claims for benefits administered by the U.S. Department of Veterans Affairs, the U.S. Department of Defense, or the Nebraska Department of Veterans' Affairs. "Compensation" is defined as any payment or benefit received in return for services. The act prohibits individuals from acting as a veteran's agent or attorney unless recognized by the Secretary of Veterans Affairs, and generally forbids receiving payment for referring veterans to others for claims assistance. It also restricts charging for services related to claims filed within one year of active duty release unless a veteran waives free services. For those providing advice or assistance, compensation must be based on a written agreement and contingent on an increase in awarded benefits, not exceeding five times the monthly increase, with no upfront or nonrefundable fees, and no interest on payment plans. Such individuals cannot guarantee a successful outcome and must provide a written disclosure stating they are not affiliated with government agencies and that free services may be available. They are also prohibited from using international data centers for client information, accessing client login credentials, and must ensure individuals accessing client data undergo background checks and that they maintain specific certifications. Violations of this act are considered deceptive trade practices. Importantly, the act does not affect fee divisions between attorneys, nor does it apply to representatives accredited by the U.S. Department of Veterans Affairs or state and county veterans service officers.
